Mediation is a type of Alternative Dispute Resolution. Alternative Dispute Resolution refers to methods used to settle matters outside of a courtroom. At MEM Law, we are trained to help facilitate communication and negotiation between parties. We work with parties to efficiently reach settlement and avoid the time and expense of trial at three key stages of the process: prior to a lawsuit being filed, after a lawsuit has been filed, but before a final trial, and when issues arise post-decision.

MEDIATION

Mediation is a process in which an impartial third party assists parties in reaching a mutually agreed upon settlement of their issues. Our firm has two trained mediators.

This office offers mediation services for a variety of matters, including:

  • Divorce/Dissolution of Marriage
    • Custody and Parenting Time
    • Child Support
    • Spousal Support
    • Division of Debts and Assets
  • Juvenile Court Custody and Child Support
  • Business Contracts
  • Business Disputes
  • Real Estate Disputes
  • Employer-Employee Issues
  • Homeowner’s Association / Neighbor-to-Neighbor Disputes
  • General Civil Law Matters

Mediation sessions are set in two or three hour increments. After each session, a Mediation Summary will be sent to all parties outlining what was discussed and any progress toward agreement. If agreement is reached, a Memorandum of Understanding will be sent out.

Rates: All mediation session are billed at a rate of $100 per hour. Payment for a mediation session is due prior to the beginning of the session. Initial mediation sessions are scheduled for a three hour block ($300). Subsequent sessions may be set for two hour blocks ($200).

COOPERATIVE NEGOTIATIONS

Not all marriages end in an adversarial court process. Equally viable options are dissolution or agreed divorce. For these types of matters, the parties will resolve all issues in advance of filing with the court. This is done through cooperative negotiations focused on achieving a mutually beneficial outcome that is fair and equitable for both parties.  A Separation Agreement is then prepared to memorialize those resolutions.
